Welcome to DialledAcknowledgment of Risks
Mountain biking involves inherent risks. By participating, you acknowledge and accept the following risks associated with mountain biking activities:
- Physical Injuries: Falls, collisions, and accidents can lead to injuries from minor scrapes to fractures, concussions, or worse, including the risk of death.
- Environmental Hazards: Uneven terrain, rocks, tree roots, changing weather, and wildlife may pose unexpected risks.
- Equipment Risks: Equipment, including bikes and helmets, may fail due to unforeseen issues. You accept responsibility for ensuring your equipment is suitable for the activity.
To manage these risks, participants agree to:
● Follow Instructions: Listen to and follow all guidance provided by coaches/instructors.
● Adhere to Safety Standards: Wear appropriate safety equipment, including a certified helmet and other recommended protective gear (e.g., gloves, knee and elbow pads).
● Maintain Equipment: Ensure your bike and other equipment are in safe, working condition before participating.
● Communicate Health Conditions: Inform the coach/instructor of any pre-existing health conditions or changes during the activity that could affect participation, including any impairment from drugs, alcohol, or fatigue.
● Self-Regulate: Ride within your skill level and communicate with instructors about comfort level, progression, or any reluctance about proceeding further.
Section 4: Terms of Participation and Code of Conduct
● Ride at your own pace, keep a safe distance from others, and always look before proceeding.
● Only ride on designated trails and those suited to your skill level.
● Give way to other trail users, including members of the public, and be respectful.
● Instructors reserve the right to withdraw any participant who may pose a danger to themselves or others or if conditions are deemed unsafe.
● By participating, you agree to uphold community relations and report any safety concerns.
Medical History and Emergency Consent
I certify that: a) I possess a sufficient degree of physical fitness and health to safely participate in the coaching program/mountain bike ride offered by Dialled, b) I understand that I am to inform the coach/guide/driver and discontinue the activity I feel undue discomfort or stress or diminished medical or health condition, c) If I know or suspect that my physical condition may not be compatible with these activities I will seek medical advice before undertaking them, c) I will indicate in writing below on this form any medical or health issues that might affect my ability to safely participate in this course, I also confirm that I accept the additional risks of participating in the activity with these conditions.
Equipment
I acknowledge that I am responsible financially for damage to equipment, including damage to vehicles or other assets caused by me.
I understand that I am responsible for ensuring my bike meets safety standards and is in a condition appropriate for the activity. I agree that I am liable for any damages or injury that may arise from my failure to meet these standards. Failure to comply with safety standards or bring a properly maintained bike or insufficient PPE can void ability to attend activity.
Emergency Medical assistance
I acknowledge that Dialled staff are not required to be medically trained, and in the event of an emergency, they will assist to the best of their ability but without guaranteeing professional medical care.
Media
I acknowledge that Dialled may take photos or videos of events, activities, clinics or coaching sessions I participate in, and I give permission to use any and all such material for marketing, advertising, website, social media or other purposes. We respect NZ privacy laws and any images posted online will be removed by request. If you do not wish to have photos shared please inform us by email before starting the lesson.
Cancellation and Rescheduling Policy
We understand that unforeseen circumstances can arise. To ensure clarity and fairness, please review our cancellation and rescheduling policy below:
Weather-Related Cancellations:
● High Winds or Risk of Thunderstorms: If severe weather conditions, such as high winds or thunderstorms, are forecasted, we reserve the right to reschedule the session to ensure safety.
● Other Adverse Weather Conditions: If we assess that other weather conditions pose a risk, we may choose to reschedule the session.
Coach-Initiated Cancellations:
● Unforeseen Circumstances: If the coach is unable to attend the session due to unforeseen circumstances, we will offer either a 100% refund or the option to reschedule at no additional cost.
Client-Initiated Cancellations:
● Cancellations Within 48 Hours: If a client cancels within 48 hours of the scheduled session start time, no refund will be provided, and rescheduling will not be offered.
● Cancellations More Than 48 Hours in Advance: If a client cancels more than 48 hours before the scheduled session, a 50% refund will be issued. Additionally, the client may reschedule the session free of charge.
General Terms:
● Notification: All cancellations or rescheduling requests should be communicated promptly to allow for appropriate adjustments.
● Refund Processing: Refunds will be processed using the original payment method and may take several business days to reflect in your account.
By scheduling a session with us, you acknowledge and agree to the terms outlined in this policy.
